1. Introduction

Welcome to the Equisense app. These Terms and Conditions of Use (“T&C”) govern access to and use of our mobile app and its services. By downloading, installing, or using the app, you unconditionally agree to the terms set forth below. 

Here are a few key points:

  • You can cancel your subscription or delete your account at any time.

  • You own your content, but you give us the right to use it.

3.1 Eligible audience
The app is intended for users who are at least 16 years old. If you are a minor, you must obtain permission from your legal guardians before using the app.

This app is intended solely for personal use. Any use for commercial purposes without the prior written consent of the publisher is strictly prohibited.

The Equisense app Equisense the following features:

  • Planning and monitoring your horses' training.

  • Analysis of data from our connected sensors.

  • Manage your horses' care, notes, and schedules.

  • Book lessons with professionals. 

  • Discuss in a group.

We strive to keep the app functional and available at all times. However, we cannot guarantee uninterrupted availability or the absence of bugs.

Participation in challenges:

As part of certain community features (such as challenges), users can choose to share certain data (for example: performance metrics, workout statistics, progress, or rankings) with other users of the app.

This sharing is strictly contingent upon the user’s explicit consent and can be disabled at any time in the app’s settings.

5. Intellectual Property

All intellectual property rights associated with the app, including its design, text, graphics, logos, and features, are the exclusive property of MICROMEGAS.

Any unauthorized reproduction, modification, or distribution of all or part of the application constitutes a violation of intellectual property rights and may result in legal action.

6. Creating and managing a user account

6.1 Creating an Account
To access certain features, you will need to create a user account. You agree to provide accurate, complete, and up-to-date information.

6.2 User Responsibility
You are responsible for keeping your login credentials (username and password) secure. Any activity carried out through your account is considered to have been performed by you. If your login credentials are lost or stolen, you must notify us immediately.

Payments are processed through the App Store and Google Play platforms. Refund policies are subject to their respective terms and conditions.

9. Liability and Warranties

9.1 Disclaimer of Warranty
The app is provided "as is" without warranty of any kind, either express or implied. Although we do our best to ensure the accuracy of the information provided, we cannot guarantee its completeness or accuracy.

9.2 Limitation of Liability
To the extent permitted by law, MICROMEGAS shall not be held liable for any direct or indirect damages arising from the use of or inability to use the application, including, but not limited to, data loss or financial loss.

10. Termination

We reserve the right to suspend or terminate your access to the app at any time, without notice, in the event of a breach of these Terms and Conditions.

You can also stop using the app at any time by deleting your account.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by French law (or the law of your jurisdiction). In the event of a dispute, and if an amicable resolution cannot be reached, the competent courts shall be those within the jurisdiction of the company’s registered office at MICROMEGAS.
